GENERAL TERMS AND CONDITIONS for the newsletter service for Mag1861 - www.mag1861.it

Article 1 - Scope

1.1 These general terms and conditions of service (hereinafter also “General Terms and Conditions”) govern the Service described in Art. 2 provided by Agenzia Giornalistica Italia S.p.A. (hereinafter also “AGI”), through the website (www.mag1861.it) it operates (hereinafter also “the Website”).

1.2 AGI may at any time modify, add to, vary and/or discontinue one or more of the components, functions or characteristics of the Service, or update and add to or modify the General Terms and Conditions for justified reasons (by way of example only, legislative/regulatory changes, technical requirements, etc.). In this case, it shall notify the user at the e-mail address provided or via appropriate notices on the Website and the platforms used for the provision of the Services or the distribution of content. These changes shall come into force 15 (fifteen) days after the publication of the notification of the change, the law or the provision by a competent Authority prevents compliance with this notice, and shall be considered accepted by the user if they continue to use the Service or to access the content or fail to terminate the existing contract with AGI in the manner indicated in Art. 6 prior to the entry into force of the aforementioned change.

Article 2 - Description of the Service

The Service governed by the General Terms and Conditions is free and consists of: Newsletter service: upon activating the service, each user shall receive, at the email address provided at the time of registration, a newsletter produced by the editorial staff of Mag1861, containing short news articles, data, information and insights on Italy and, more specifically, great Italian products.

Article 3 - Registration for the Services

3.1 To access the content and/or use the Services, you must complete the Registration Form and read and accept the General Terms and Conditions.

3.2 Unless otherwise indicated in specific documents, the General Terms and Conditions shall be effective from the moment the user begins to use the Services or accesses the content and - subject to possible changes pursuant to the provisions of Art. 1.2 above - shall remain valid as long as the user continues to use the Services provided by AGI.

Article 4 - Property rights

4.1 AGI is the owner or licensee of all industrial and intellectual property rights on the content (e.g. texts, images, videos, trademarks, distinctive signs, etc.) made available to users through the Service.

4.2 Users are expressly prohibited from any use of said content - including reproducing, copying, publishing or commercially exploiting -, which they may only use as end users and for personal purposes.

Article 5 - Personal data

5.1 The user undertakes to provide AGI with correct and truthful personal data, as necessary from time to time for the registration, access or use of the contents and Services.

5.2 The Personal Data acquired by AGI shall, in any case, be processed by AGI exclusively for the purpose of providing the requested Service to the user, except in the case of data published by the user in public areas of the AGI site or unless the user has given specific consent for different and further uses. The terms and conditions of the processing of such data by AGI are duly described in the privacy policy.

5.3 The user acknowledges and accepts that AGI, upon request, shall provide the Judicial Authority and/or any other competent authority with any element and/or data and/or information identifying the user and any information or content in its possession referring to the user and requested by the Judicial Authority and/or by any other competent authority.

Article 6 - Withdrawal and unsubscribing

The user may at any time withdraw from these General Terms and Conditions by unsubscribing from the newsletter in the following ways. The withdrawal takes effect immediately upon receipt by AGI of the request to unsubscribe. The user can unsubscribe at any time through the corresponding option “unsubscribe from this list” found at the bottom of each newsletter received.

Article 7 - Applicable law and competent court

7.1 The execution of the Services and these general terms and conditions are governed by Italian law.

7.2 In the case of users who qualify as consumers, pursuant to current legislation, for all disputes that may arise in relation to the execution of the Services and/or the application and/or interpretation of these General Terms and Conditions, the court of the place of residence or of the domicile elected by the user in Italian territory shall have exclusive jurisdiction. In all other cases, the Court of Rome shall have exclusive jurisdiction.
